Consent to Mediate
This is a contractual agreement that includes the parameters of the mediation including the commitment to proceed with the process.
This agreement is presented to the participants at the start of the mediation to review and sign. The participants and the mediator receive a copy for their records. Participants may be given a copy of this agreement prior to the mediation so they and / or their lawyers can review it.
This refers to what information will or will not be shared outside the mediation and with whom it will be shared.
Generally, the conversations that take place in mediation, stay in mediation.
The agreement reached in mediation is written up into a Mediated Agreement by the mediator.
This agreement can be made legally binding through a lawyer or the Courts if the individuals involved in the mediation agree to do so.
